So how will the changes to the legislation affect builders and building trades people?

The new legislation (the new Act) will enable ICI to introduce a registration system for builders and building trades. See clause 54 (j) in the Bill.

Building trades means builders, plumbers, gas fitters, stormwater drainlayers, architects and drafters, tilers and structural engineers. 

No existing trades person will be prevented from working under this system. The intent of the registration system is to recognise existing experience, support progression, and ensure that building work is carried out safely and appropriately for its level of complexity.

A tier level system is proposed to reflect the different skill levels required for different levels of building work. For example, people new to the industry would be registered in Level 1 (Entry Level) of the tier system. Over time, as experience and/or qualifications are obtained, builders will move higher in the tier levels. 1.Why is a registration system being introduced?

Currently, there is no formal system for regulating who can carry out building work in the Cook Islands.

This has made it difficult to:

  • Ensure builders have the right level of experience for the work they undertake
  • Address concerns about workmanship and professional conduct
  • Provide accountability where issues arise


The new registration system will help improve the quality, reliability, and accountability of building work across the Cook Islands.

2. What is the registration system?

The registration system is a way to formally (by law) record who and what companies are operating in the Cook Islands. A register of trades and companies will be maintained.

A tiered system will ensure that building work is matched to the appropriate level of experience and skill. Over time, tradespeople can progress to higher tiers as they gain more experience or qualifications.

3. How will the system work?

  • Applications will be assessed by the Building Board
    • Applicants will be placed into a tier level based on experience and qualifications (if any).

  • Approved applicants will be allowed to undertake work that requires a building permit, within their approved tier level or higher if supervised by the appropriately tiered supervisor.
  • The system will include the ability to:
    • Suspend or revoke registration in cases of misconduct
    • Support professional standards and accountability
  • Companies will be able to undertake work based on the level of their highest-tier registered builder.

4. What does this mean for builders?

  • You must register if you intend to work on buildings that require a building permit
  • You can still work – the system is not designed to exclude people
  • Experience is recognised – formal qualifications are not required
  • The system supports:
    • Fairness across the industry
    • Recognition of skilled builders
    • Better trust from clients
